These Terms of Service govern your use of the BYOUR platform, operated by BYOUR Platform Ltd., a company registered in Ireland. By creating an account, you agree to these terms. Please read them carefully — they define the rights and responsibilities of everyone on the platform.
1 What BYOUR Is
BYOUR provides hiring software and recruitment services. BYOUR Stack is a subscription hiring platform — a hosted careers page, applicant tracking, and automated scoring of candidates against the requirements of a role. BYOUR Hire is a recruitment service in which BYOUR runs a search and presents a shortlist for a fixed fee per hire. Candidates use BYOUR free of charge to maintain a profile and be matched to open roles.
BYOUR is not an employer and is not a party to any employment or engagement agreement you enter into with a candidate or an organisation. Hiring decisions, and the terms of any resulting employment or contract, are entirely yours.
2 Account Eligibility
To use BYOUR, you must:
- Be at least 18 years of age
- Have the legal authority to enter into contracts in your jurisdiction, and — where you register on behalf of an organisation — authority to bind it
- Provide accurate, complete, and current information during registration
- Not be prohibited from using the platform under applicable law
One account per person or legal entity. Creating duplicate accounts is prohibited and may result in suspension of all associated accounts.
3 Hiring Organisation Responsibilities
If you use BYOUR to hire, you agree to:
- Publish roles that are genuine, lawful, clearly described, and actually open
- Make hiring decisions lawfully and without unlawful discrimination
- Treat candidate data as confidential, and use it only to assess candidates for the role it was submitted for
- Act as the data controller for candidate personal data you receive, and handle it in accordance with applicable data protection law
- Keep your subscription and any placement fees paid up to date
- Not republish, resell, or export candidate data off the platform for any other purpose
You are solely responsible for the legal compliance of your hiring, including employment law, right-to-work checks, and any obligations arising from the employment or contract you ultimately agree.
4 Candidate Responsibilities
If you use BYOUR to find work, you agree to:
- Maintain an accurate and honest profile reflecting your actual skills and experience
- Represent your qualifications, employment history, and right to work truthfully
- Apply only for roles you are genuinely interested in and able to perform
- Keep to your own account, and not apply on another person’s behalf
Your profile is shown to organisations hiring through BYOUR. You may update or remove it, and close your account, at any time.
5 Prohibited Activities
The following are prohibited and may result in immediate account termination:
- Providing false identity information or impersonating another person or entity
- Posting roles for illegal activities, or roles that do not exist
- Harvesting, scraping, or bulk-exporting candidate profiles or contact details
- Attempting to manipulate matching, scoring, or ranking on the platform
- Harassing, threatening, or abusing other platform users
- Using the platform for fraud, money laundering, or other financial crime
- Sharing access credentials, or allowing more people than your plan’s seats to use one account
6 Subscriptions, Fees & Payments
All payments are processed by Stripe, subject to Stripe’s terms and privacy policy. BYOUR does not store your card details.
BYOUR Stack is sold as a subscription, billed monthly or annually in advance. Where a free trial is offered, the subscription begins automatically at the end of the trial unless you cancel before it ends. Subscriptions renew for further periods until cancelled. You may cancel at any time, and cancellation takes effect at the end of the period already paid for.
BYOUR Hire is charged as a single fixed fee per hire, set by the seniority of the role rather than the salary agreed. The fee and any replacement terms are confirmed in writing before a search begins, and the fee becomes payable when a candidate introduced by BYOUR accepts an offer.
All fees are exclusive of applicable VAT. Fees already paid are non-refundable except where refund is required by applicable law. Prices may change with reasonable notice; a change never affects a period you have already paid for.
7 Intellectual Property
You keep ownership of the content you put on BYOUR — job descriptions, profiles, CVs, and anything else you upload. You grant BYOUR a non-exclusive licence to host, process, and display that content as far as is necessary to provide the service to you.
All intellectual property in the BYOUR platform itself — including software, design, trademarks, scoring models, and documentation — belongs exclusively to BYOUR Platform Ltd. You may not copy, reverse-engineer, or create derivative works from it.
8 Limitation of Liability
BYOUR provides software and recruitment services. Scoring and matching are decision support, not a guarantee: BYOUR does not warrant that any candidate will be suitable, will accept an offer, or will remain in a role, and is not liable for the conduct of any candidate or organisation, or for the outcome of any hire.
To the maximum extent permitted by applicable law, BYOUR’s total liability to you for any claim arising under these terms shall not exceed the total fees paid by you in the 12 months preceding the claim. BYOUR is not liable for indirect, incidental, consequential, or punitive damages arising from use of the platform.
9 Account Termination
You may close your account at any time by contacting support@byour.co. Closing an account cancels any subscription from the end of the period already paid for; fees already incurred, including a placement fee for a hire already made, remain payable.
BYOUR reserves the right to suspend or terminate accounts that violate these Terms, with or without notice. In cases of serious breach, termination is immediate.
10 Governing Law
These Terms are governed by the laws of the Republic of Ireland. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the Irish courts, except where mandatory consumer protection laws in your jurisdiction provide otherwise.
